Court Orders Retrial on Unresolved Charges

British rapper, YouTuber and social media personality Yung Filly will face a retrial in Australia on three counts of rape, following a jury's inability to reach verdicts on those charges after an earlier trial. Both ABC Australia and the BBC reported that prosecutors are proceeding with the retrial on the three remaining sexual penetration charges. The entertainer, whose full name is given by the BBC as Andres Felipe Valencia Barrientos and by ABC Australia as Andres Barrientos, was originally charged in connection with events after a nightclub performance in Perth in 2024.

According to ABC Australia, the decision came after an eight-day trial that concluded with mixed results. The BBC noted that Yung Filly had denied all ten charges brought against him. He remains on bail and is scheduled for a further court appearance, with the BBC specifying 27 August for an application to vary bail conditions while ABC Australia stated he would appear again the following week. No date has yet been set for the retrial itself, the BBC reported, and there was no discussion in court about whether it would proceed before a judge or a jury.

Mixed Verdicts from the Original Trial

The jury delivered a split set of findings. ABC Australia and the BBC both reported that Yung Filly was found guilty of two counts of assault occasioning bodily harm. Sentencing on those convictions has been deferred until after the retrial, according to both outlets.

On the sexual offences, the jury found him not guilty on three counts of sexual penetration without consent, as reported by ABC Australia and the BBC. ABC Australia added that he was also found not guilty of two other assault charges. The BBC specified that he was acquitted of one assault charge and one strangulation charge. The three charges on which the jury could not agree form the basis of the forthcoming retrial. ABC Australia noted that the acquittals on the rape-related counts had come roughly three weeks before the latest court hearing.

Account of the Alleged Incident

The case centres on an encounter with a woman who was 20 years old at the time. Both sources reported that the court heard the pair had engaged in consensual sex after Yung Filly performed at Bar 120 in Hillarys. According to ABC Australia, the woman told the earlier trial that the encounter later moved to a hotel in Perth's central business district, where she said it became non-consensual when the rapper did things she did not want. The BBC summarised the prosecution case as alleging that he turned violent and ignored her cries to stop.

Yung Filly testified in his own defence. ABC Australia reported that he denied hitting the woman or holding her by the throat. He admitted giving her "love bites" but maintained that all the sexual acts were consensual. Prosecutor Danielle Clarke told the court on Friday that the complainant was "more than willing to give evidence" again at a retrial, ABC Australia reported.
