Kroger has agreed to pay $17 million to settle a class action lawsuit over prescription pricing, according to reports from USA Today and court documents. The settlement resolves allegations that the grocery chain failed to apply discounted prices from its Kroger Savings Club to certain insured customers' prescriptions.
The lawsuit, filed in January 2021 in the U.S. District Court for the Southern District of Ohio, claimed that between December 2018 and August 2026, Kroger charged some insured customers more for certain prescriptions than it should have. Court documents alleged that Kroger did not factor in the lower prices available through its Kroger Savings Club, leading to higher out-of-pocket costs for some customers.
Kroger has denied any wrongdoing. The company stated that its discount savings club prices are only available to members who paid a yearly fee, and therefore those discounts were not part of the regular pricing structure for insured customers.
The settlement covers individuals who paid for one or more prescriptions—either in full or partially—with insurance during the period from December 9, 2018, through August 23, 2026. The settlement website indicates that eligible class members may be entitled to a portion of the $17 million fund, though individual payment amounts have not been specified.
Affected customers can file a claim online using the claim number provided in the notice they received from the Settlement Administrator. Those who did not receive a notice can also use the same link and will be directed to an alternative form.
The deadline to submit a claim is December 21, 2026. A final hearing to approve the settlement is scheduled for January 11, 2027.
