The 15-year-old son of Kim Zolciak and Kroy Biermann, Kroy "KJ" Jagger Biermann Jr., was arrested in Alpharetta, Georgia, on August 17. He faces two felony charges: aggravated sodomy and aggravated sexual battery, according to court documents obtained by multiple outlets. KJ is being charged as an adult under Georgia's SB440 law, which allows adult superior courts to handle cases involving teenagers aged 13 to 17 accused of specific violent felonies.
Alleged Incident
The charges stem from an alleged incident on April 23 at a Life Time fitness center in Alpharetta. According to court documents cited by several news organizations, a female classmate accused KJ of assaulting her inside a co-ed sauna. The alleged victim, who was 15 at the time and described herself as "KJ's girlfriend's best friend," claimed KJ attempted multiple times to have sexual intercourse with her by pulling down her pants, forced oral sex, and digitally penetrated her. She said she told him no multiple times but he continued. She told authorities she was able to get away, and he left.
The alleged victim did not report the incident immediately. The next day, she went to school, encountered KJ's girlfriend, and fled to a Starbucks, where she contacted her family about having a panic attack. She was examined at North Fulton Hospital on April 24. A police report states that no male DNA was found in her mouth or vagina.
Sources differ on the exact date of the incident and the hearing date. While most reports say the incident occurred April 23, some say April 24. Similarly, the preliminary hearing is listed as September 1 in some reports and September 8 in others.
Legal Status and Attorney's Response
KJ is being held without bond. Reports vary on the facility: some say he is at the Metro Regional Youth Detention Center, while others say he is at the Juvenile Court of Fulton County.
His attorney, Jason Sheffield, has vigorously denied the allegations. In statements reported by multiple outlets, Sheffield said KJ is "100% innocent," passed a polygraph administered by a notable sex offender polygrapher, and that the officer's report notes no male DNA was found. Sheffield also claimed he has evidence of other prior false allegations by the alleged victim, suggesting the accusations are a "desperate cry for attention" motivated by "client's past rejection of the alleged victim's unwanted advances." He criticized the decision to hold KJ without bond, calling it a "tragedy."
Kim Zolciak's Statement
Kim Zolciak, KJ's mother, has publicly defended her son. In a statement provided to multiple outlets, she called the allegations "reckless and deeply troubling" and said KJ "categorically denies ever being involved with this woman." She noted that KJ passed a polygraph and that no DNA belonging to him was found. She also claimed the alleged victim has made "similar allegations involving two other people," which she said "raises serious concerns that deserve to be carefully examined." Notably, TMZ and other outlets have stated that her claim about the alleged victim has not been verified.
Zolciak also emphasized the broader impact of false accusations: "False accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation."
Family Background
Kim Zolciak and Kroy Biermann married in 2011 and have four children together: KJ, Kash, and twins Kaia and Kane. Biermann also adopted Zolciak's two daughters from a previous relationship, Ariana and Brielle. The couple filed for divorce in 2023 and are currently living apart, with the divorce still in process, according to a 2025 Bravo interview in which Zolciak said, "I would like to communicate more regarding the children, but it's just not there right now."

Since the arrest, both parents have been seen in public for the first time. Kim Zolciak was photographed driving in Alpharetta. Kroy Biermann was spotted picking up 14-year-old Kash from football practice on Saturday, appearing "glued to his phone" and wearing a white T-shirt and black jeans.
The case remains under investigation, and Alpharetta police have not responded to requests for additional information.
